General Terms and Conditions of Delivery and Business of UDOBLiCK GmbH

1. Con­trac­ting Par­ty
The con­trac­ting par­ty is UDO­B­LiCK GmbH (her­ein­af­ter refer­red to as UDO­B­LiCK GmbH).

2. Con­clu­si­on of the con­tract
The con­tract is con­cluded upon online boo­king. After the online boo­king, we will send a bin­ding con­fir­ma­ti­on by email to the email address provided.

3. Can­cel­la­ti­on policy

right of with­dra­wal
You have the right to with­draw from this con­tract within four­teen days wit­hout giving any reason. The with­dra­wal peri­od is four­teen days from the date of con­clu­si­on of the contract.

To exer­cise your right of with­dra­wal, you must inform us (UDO­B­LiCK GmbH, Seve­ri­nus­tras­se 35, 57482 Wen­den, Ger­ma­ny, Kontakt@udoblick.de, pho­ne: 02762–9898446) of your decis­i­on to with­draw from this con­tract by means of a clear state­ment (e.g., a let­ter sent by post, fax, or email). You can use the atta­ched sam­ple with­dra­wal form for this pur­po­se, but this is not mandatory.

To com­ply with the with­dra­wal peri­od, it is suf­fi­ci­ent that you send the noti­fi­ca­ti­on of your exer­cise of the right of with­dra­wal befo­re the expiry of the with­dra­wal period.

Con­se­quen­ces of revocation

If you with­draw from this con­tract, we shall reim­bur­se you for all pay­ments we have recei­ved from you, inclu­ding deli­very cos­ts (with the excep­ti­on of addi­tio­nal cos­ts resul­ting from your choice of a type of deli­very other than the che­a­pest stan­dard deli­very offe­red by us), wit­hout delay and at the latest within four­teen days of the day on which we recei­ve noti­fi­ca­ti­on of your with­dra­wal from this con­tract. We will use the same means of pay­ment for this refund as you used for the ori­gi­nal tran­sac­tion, unless express­ly agreed other­wi­se with you; in no event will you be char­ged for this refund.

If you have reques­ted that the ser­vices should com­mence during the with­dra­wal peri­od, you must pay us a reasonable amount cor­re­spon­ding to the pro­por­ti­on of the ser­vices alre­a­dy pro­vi­ded up to the point in time at which you inform us of the exer­cise of the right of with­dra­wal with regard to this con­tract, com­pared to the total scope of the ser­vices pro­vi­ded for in the contract.

The­re are no addi­tio­nal cos­ts for reboo­king or con­ver­ting to a vou­ch­er, except of cour­se the ori­gi­nal invoice amount.

4. Ren­tal peri­od
Unless other­wi­se agreed, the ren­tal peri­od (use of the box) is 1 day. The box usual­ly arri­ves on Thurs­days and is then sent back on Mon­days (as a rule). The­re are, of cour­se, excep­ti­ons depen­ding on the ren­tal date.

5. Con­trac­tu­al obli­ga­ti­ons of the ten­ant
The ren­ter is obli­ged to pro­vi­de UDBLiCK GmbH with a cor­rect deli­very address in good time. In the case of short-term boo­kings, the cus­to­mer will be gran­ted a reasonable peri­od of time.
The item must be han­ded over to the ship­ping ser­vice pro­vi­der desi­gna­ted by UDO­B­LiCK GmbH for return ship­ment in full on the next working day after the end of the ren­tal peri­od. This is usual­ly Mon­day (other days are also pos­si­ble by arrangement).

The ten­ant must ensu­re that the pho­to booth and equip­ment are used pro­per­ly. This includes, in par­ti­cu­lar, obser­ving the enc­lo­sed ope­ra­ting ins­truc­tions. The equip­ment may only be set up in dry indoor are­as. The attach­ment of for­eign mate­ri­als to the pro­per­ty of UDOLiCK GmbH (in par­ti­cu­lar by means of adhe­si­ve labels) is not per­mit­ted. Sub­let­ting to third par­ties is gene­ral­ly pro­hi­bi­ted wit­hout the express con­sent of UDO­B­LiCK GmbH.

6. Pri­ces, terms of pay­ment
The ren­tal pri­ce is based on the con­trac­tual­ly agreed equip­ment packa­ge and is bin­din­gly spe­ci­fied in the docu­ments.
Pay­ment is made by bank transfer.

7. Ship­ping, pack­a­ging
The ship­ping cos­ts for deli­very and return are always included in the ren­tal pri­ce. The return label pro­vi­ded must be used for returns. If the label pro­vi­ded is not used or not reques­ted if miss­ing, the ren­ter shall bear the addi­tio­nal cos­ts incur­red. Returns sent freight coll­ect will be invoi­ced to the ren­ter retro­s­pec­tively. The goods must be pro­tec­ted against dama­ge during return trans­port using the trans­port packaging.

8. Loss/Damage
UDBLiCK GmbH assu­mes full risk for loss or dama­ge to ren­tal items during ship­ping. The goods must be inspec­ted imme­dia­te­ly upon receipt and any dama­ge must be repor­ted to UDO­B­LiCK GmbH imme­dia­te­ly (within 24 hours). In this case, plea­se cont­act us imme­dia­te­ly.
The fol­lo­wing dama­ges are excluded from this pro­vi­si­on and must be bor­ne in full by the tenant:

1. Dama­ge cau­sed by fail­ure to fol­low the ins­truc­tions, usa­ge and safe­ty infor­ma­ti­on pro­vi­ded (e.g., set­ting up in the rain, etc., i.e., gross negli­gence).
2. Theft or loss of the pho­to booth
3. Unaut­ho­ri­zed ope­ning or tam­pe­ring with the pho­to booth or other ren­tal items
4. impro­per or inap­pro­pria­te use (e.g., using the box as an under­wa­ter came­ra, etc.)
9.Incomplete or miss­ing ser­vice provision

In the event of incom­ple­te or miss­ing ser­vice pro­vi­si­on on the part of UDO­B­LiCK GmbH (tech­ni­cal mal­func­tion, etc.), lia­bi­li­ty shall be limi­t­ed to a maxi­mum of the ren­tal pri­ce char­ged. Any fur­ther claims on the part of the ren­ter are excluded.
The orga­niza­ti­on and allo­ca­ti­on of pho­to booth boo­kings, as well as their exe­cu­ti­on, are car­ri­ed out with the utmost care. Howe­ver, if, due to cir­cum­s­tances bey­ond the con­trol of UDO­B­LiCK GmbH (e.g., sud­den loss of the pho­to booths due to theft, errors during trans­port, or serious dama­ge, or serious tech­ni­cal defects, etc.), a pho­to booth can­not be ship­ped and/or the enti­re ser­vice can­not be pro­vi­ded, no lia­bi­li­ty can be accept­ed for any resul­ting damages.

10. Reten­ti­on of title
All ren­tal items remain the pro­per­ty of UDO­B­LiCK GmbH. This appli­es in par­ti­cu­lar to unu­sed prin­ting mate­ri­als (ink rib­bons and pho­to paper), which must be retur­ned after the event tog­e­ther with the other items. Only after the inten­ded prin­tout via the pho­to box does the prin­ted mate­ri­al beco­me the pro­per­ty of the ren­ter.
The USB stick con­tai­ning the pho­tos of the event beco­mes the pro­per­ty of the ren­ter. The copy­right and explo­ita­ti­on rights to the pho­tos remain with the ren­ter. In order to pro­vi­de the ser­vice, it is neces­sa­ry for the pho­tos taken to remain in the inter­nal memo­ry of the pho­to box in addi­ti­on to the USB stick. The­se are not regu­lar­ly read out and are auto­ma­ti­cal­ly dele­ted from the device after the pho­to box is retur­ned. The ren­ter agrees to this form of data sto­rage. Befo­re retur­ning the device, the ren­ter must check that all their images are on the stick. Other­wi­se, plea­se noti­fy UDO­B­LiCK GmbH imme­dia­te­ly by email.

11. Refe­rence use
The les­see agrees that their logo and/or brand and/or com­pa­ny name may be used as a refe­rence on the UDO­B­LiCK GmbH web­site and in bro­chu­res.
The ten­ant may revo­ke this refe­rence use at any time by noti­fy­ing UOB­LiCK GmbH. The revo­ca­ti­on must be made in wri­ting, e.g. by email or post, and sent to: UDO­B­LiCK GmbH, Kamp­stras­se 1, 57482 Wen­den, Ger­ma­ny. Email: kontak@udoblick.de
The revo­ca­ti­on of con­sent does not affect the lega­li­ty of the refe­rence use that took place pri­or to revo­ca­ti­on. Upon receipt of the revo­ca­ti­on, UDO­B­LiK GmbH under­ta­kes to cea­se using the trade­mark and/or logo and/or com­pa­ny name within a peri­od of 14 days.
The les­see assu­res UDO­B­LiCK GmbH that the trade­mark and/or logo and/or com­pa­ny name are free from third-par­ty legal claims, in par­ti­cu­lar copy­rights or simi­lar pro­per­ty rights. In the event of a vio­la­ti­on of this pro­vi­si­on, UDO­B­LiC GmbH shall be indem­ni­fied against any claims for compensation.

12. Severa­bi­li­ty clau­se
Should indi­vi­du­al pro­vi­si­ons of the­se Gene­ral Terms and Con­di­ti­ons and/or the con­tract sup­ple­men­ted by them be or beco­me inva­lid, this shall not affect the vali­di­ty of the other pro­vi­si­ons. In the event of an indi­vi­du­al pro­vi­si­on being inva­lid, the con­trac­ting par­ties shall endea­vor to reach a new agree­ment that takes into account the inte­rests of both par­ties and comes as clo­se as pos­si­ble to the eco­no­mic pur­po­se of the inva­lid provision.

The­se terms and con­di­ti­ons are valid from Janu­ary 1, 2019, and all pre­vious terms and con­di­ti­ons are no lon­ger valid.
