General Terms and Conditions of Delivery and Business of UDOBLiCK GmbH

1. Contracting Party
The contracting party is UDOBLiCK GmbH (hereinafter referred to as UDOBLiCK GmbH).
2. Conclusion of the contract
The contract is concluded upon online booking. After the online booking, we will send a binding confirmation by email to the email address provided.
3. Cancellation policy
right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform us (UDOBLiCK GmbH, Severinustrasse 35, 57482 Wenden, Germany, Kontakt@udoblick.de, phone: 02762–9898446) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory.
To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of revocation
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.
If you have requested that the services should commence during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you inform us of the exercise of the right of withdrawal with regard to this contract, compared to the total scope of the services provided for in the contract.

There are no additional costs for rebooking or converting to a voucher, except of course the original invoice amount.
4. Rental period
Unless otherwise agreed, the rental period (use of the box) is 1 day. The box usually arrives on Thursdays and is then sent back on Mondays (as a rule). There are, of course, exceptions depending on the rental date.
5. Contractual obligations of the tenant
The renter is obliged to provide UDBLiCK GmbH with a correct delivery address in good time. In the case of short-term bookings, the customer will be granted a reasonable period of time.
The item must be handed over to the shipping service provider designated by UDOBLiCK GmbH for return shipment in full on the next working day after the end of the rental period. This is usually Monday (other days are also possible by arrangement).
The tenant must ensure that the photo booth and equipment are used properly. This includes, in particular, observing the enclosed operating instructions. The equipment may only be set up in dry indoor areas. The attachment of foreign materials to the property of UDOLiCK GmbH (in particular by means of adhesive labels) is not permitted. Subletting to third parties is generally prohibited without the express consent of UDOBLiCK GmbH.
6. Prices, terms of payment
The rental price is based on the contractually agreed equipment package and is bindingly specified in the documents.
Payment is made by bank transfer.
7. Shipping, packaging
The shipping costs for delivery and return are always included in the rental price. The return label provided must be used for returns. If the label provided is not used or not requested if missing, the renter shall bear the additional costs incurred. Returns sent freight collect will be invoiced to the renter retrospectively. The goods must be protected against damage during return transport using the transport packaging.
8. Loss/Damage
UDBLiCK GmbH assumes full risk for loss or damage to rental items during shipping. The goods must be inspected immediately upon receipt and any damage must be reported to UDOBLiCK GmbH immediately (within 24 hours). In this case, please contact us immediately.
The following damages are excluded from this provision and must be borne in full by the tenant:
1. Damage caused by failure to follow the instructions, usage and safety information provided (e.g., setting up in the rain, etc., i.e., gross negligence).
2. Theft or loss of the photo booth
3. Unauthorized opening or tampering with the photo booth or other rental items
4. improper or inappropriate use (e.g., using the box as an underwater camera, etc.)
9.Incomplete or missing service provision
In the event of incomplete or missing service provision on the part of UDOBLiCK GmbH (technical malfunction, etc.), liability shall be limited to a maximum of the rental price charged. Any further claims on the part of the renter are excluded.
The organization and allocation of photo booth bookings, as well as their execution, are carried out with the utmost care. However, if, due to circumstances beyond the control of UDOBLiCK GmbH (e.g., sudden loss of the photo booths due to theft, errors during transport, or serious damage, or serious technical defects, etc.), a photo booth cannot be shipped and/or the entire service cannot be provided, no liability can be accepted for any resulting damages.
10. Retention of title
All rental items remain the property of UDOBLiCK GmbH. This applies in particular to unused printing materials (ink ribbons and photo paper), which must be returned after the event together with the other items. Only after the intended printout via the photo box does the printed material become the property of the renter.
The USB stick containing the photos of the event becomes the property of the renter. The copyright and exploitation rights to the photos remain with the renter. In order to provide the service, it is necessary for the photos taken to remain in the internal memory of the photo box in addition to the USB stick. These are not regularly read out and are automatically deleted from the device after the photo box is returned. The renter agrees to this form of data storage. Before returning the device, the renter must check that all their images are on the stick. Otherwise, please notify UDOBLiCK GmbH immediately by email.
11. Reference use
The lessee agrees that their logo and/or brand and/or company name may be used as a reference on the UDOBLiCK GmbH website and in brochures.
The tenant may revoke this reference use at any time by notifying UOBLiCK GmbH. The revocation must be made in writing, e.g. by email or post, and sent to: UDOBLiCK GmbH, Kampstrasse 1, 57482 Wenden, Germany. Email: kontak@udoblick.de
The revocation of consent does not affect the legality of the reference use that took place prior to revocation. Upon receipt of the revocation, UDOBLiK GmbH undertakes to cease using the trademark and/or logo and/or company name within a period of 14 days.
The lessee assures UDOBLiCK GmbH that the trademark and/or logo and/or company name are free from third-party legal claims, in particular copyrights or similar property rights. In the event of a violation of this provision, UDOBLiC GmbH shall be indemnified against any claims for compensation.
12. Severability clause
Should individual provisions of these General Terms and Conditions and/or the contract supplemented by them be or become invalid, this shall not affect the validity of the other provisions. In the event of an individual provision being invalid, the contracting parties shall endeavor to reach a new agreement that takes into account the interests of both parties and comes as close as possible to the economic purpose of the invalid provision.
These terms and conditions are valid from January 1, 2019, and all previous terms and conditions are no longer valid.
